These Terms and Conditions apply to all bookings made with Megan Donati Photography and form part of the agreement between the Photographer and the Client.
1. Exclusive Photographer
Megan Donati Photography shall be the exclusive professional photographer retained by the Client for the purpose of photographing the booked event.
Family members, guests and friends are welcome to take photographs throughout the day, provided they do not interfere with the Photographer’s work, block important moments, or photograph poses arranged by the Photographer.
2. Booking Fee and Payment
A non-refundable booking fee of 25% of the total package price is required to secure the event date.
No booking is confirmed until both the signed contract and booking fee have been received.
The remaining balance must be paid in full no later than 4 weeks (30 days) before the event date.
Failure to make final payment by the due date may result in cancellation of services.
3. Cancellation by the Client
If the Client cancels the booking, the booking fee remains non-refundable as compensation for loss of business and reservation of the date.
If cancellation takes place:
• within 6 weeks of the event date, 50% of the full package price remains payable
• within 4 weeks of the event date, 100% of the full package price remains payable
This applies because the Photographer is unlikely to rebook the date at short notice.
4. Photographic Materials and Delivery
All photographic materials remain the exclusive property of Megan Donati Photography.
This includes:
• digital files
• RAW files
• edited images
• storage media
• gallery files
The Photographer will provide an online gallery containing edited digital images.
Images are supplied for personal use only.
Images may not be used for business, commercial use, publication, resale, competitions or marketing without written permission from the Photographer.
RAW files are never supplied.
5. Copyright and Usage
Copyright remains at all times with Megan Donati Photography.
The Photographer reserves the right to use images for legitimate business purposes including:
• website portfolio
• social media
• blog features
• marketing
• printed materials
• awards and publications
The Client may download, print and share images for personal use.
Commercial use is strictly prohibited without prior written permission.
6. Insurance and Image Security
The Photographer holds valid Public Liability Insurance and Professional Indemnity Insurance.
Proof of insurance can be provided on request.
The Photographer also takes reasonable professional steps to protect image files, including:
• dual card camera recording where available
• multiple backups
• external storage
• cloud or secondary archive systems where appropriate
7. Failure to Perform
If the Photographer is unable to attend due to illness, injury, emergency, accident or circumstances beyond reasonable control, every effort will be made to provide a trusted associate photographer.
If this is not possible, all monies paid by the Client will be refunded in full.
This shall be the full extent of liability.
The Photographer is not liable for loss caused by:
• corrupted files
• technical failure
• lost files
• damaged storage
• circumstances outside reasonable control
where all reasonable professional precautions have been taken.
8. Requested Images and Coverage Limitations
The Photographer will always aim to capture all important moments discussed before the event.
However, specific images cannot be guaranteed if affected by:
• weather
• venue restrictions
• delays
• poor light
• guest interference
• time limitations
• circumstances outside the Photographer’s control
The Photographer will use professional judgement throughout the day to document events naturally.
9. Travel and Accommodation
Travel within agreed coverage areas is included unless otherwise stated.
The Client is responsible for any additional costs including:
• parking
• tolls
• venue entry fees
• ferry charges
• special access fees
Accommodation may be required where distance, finish time, safety or logistics make same-day travel unreasonable.
Where accommodation is required, this will be discussed and agreed before booking.
The Photographer reserves discretion regarding whether accommodation is necessary.
10. Force Majeure
If the Photographer is unable to perform services due to events beyond reasonable control including but not limited to:
• severe weather
• government restrictions
• natural disaster
• pandemic
• war
• strikes
• civil unrest
• transport disruption
liability shall be limited to monies paid by the Client.
The booking fee remains non-refundable where work has already been undertaken or date reserved.
The Photographer is not responsible for any additional losses incurred by the Client.
11. Harassment, Safety and Unsafe Conditions
The Photographer reserves the absolute right to stop coverage and leave the event immediately if at any time they or any associate photographer feel unsafe.
This includes but is not limited to:
• harassment
• threatening behaviour
• abuse
• intoxicated aggression
• unsafe venue conditions
• unsafe travel conditions
No refund will be given if services are stopped for safety reasons.
12. Privacy and Data Protection
Megan Donati Photography respects the Client’s privacy and processes personal information in accordance with UK GDPR.
Personal data is collected only where necessary for:
• enquiries
• bookings
• communication
• contracts
• invoicing
• gallery delivery

13. Associate Photographer Clause
Where an associate photographer is provided, Megan Donati Photography remains the lead contracted business.
All editing, communication and delivery remain under Megan Donati Photography unless otherwise agreed.
Associate photographers are selected carefully to reflect the same style and standard of service.
14. Image Editing and Artistic Style
The Client acknowledges that they are familiar with the Photographer’s style and portfolio.
Final editing decisions remain at the Photographer’s discretion.
RAW files and unedited files are not supplied.
15. Gallery Retention
Online galleries are normally available for a limited time after delivery.
Clients are responsible for downloading and storing their images once delivered.
Long-term archive storage is not guaranteed.
16. Agreement
Payment of booking fee confirms acceptance of these Terms and Conditions.
